Customer Responsibility for Logo and Design Intellectual Property
The customer acknowledges and agrees that they shall bear full and exclusive responsibility for any logos, designs, trademarks, copyrights, or other intellectual property (“Customer IP”) that they provide, upload, or instruct to be placed on any product.
This responsibility includes, but is not limited to:
- Ownership & Rights: The customer warrants that they own or have a valid license to use all Customer IP.
- Infringement Liability: The customer assumes all legal and financial liability if the Customer IP infringes upon any third-party trademark, copyright, design right, or other intellectual property right.
- Indemnification: The customer agrees to indemnify, defend, and hold harmless the company (manufacturer/service provider) against any claims, damages, or legal fees arising from the use of the Customer IP on the product.
- No Vetting Obligation: The company has no obligation to vet or verify the legal status of the Customer IP and relies entirely on the customer’s representation of ownership.
